Guardianship and Funding Questions for Parents

Who could care for your children if you could not—and who would manage funds for their support? These related questions may require different people and legal arrangements.

Your attorney advises on guardianship and legal documents. Anil helps you explore insurance funding for the needs you identify.

Start with the people

Separate the care role from the money role

A person caring for a child and a person managing property for that child may have different responsibilities. Discuss suitable primary and backup choices, practical needs and relevant family circumstances with your attorney.

State law and the circumstances determine any required court process. Do not assume that a conversation, a named beneficiary or an insurance application appoints a guardian.

Prepare three questions for your attorney

  • Care: What documents and process would apply if a child needed someone else to provide care?
  • Property: Who could receive and manage assets for a minor, and when could the child gain control?
  • Ongoing support: How should planning account for a child or adult dependent with a disability or public benefits?

Do not assume one state’s age limits, procedures or trust rules apply everywhere. Get advice for your family’s circumstances before naming beneficiaries or transferring assets.

Funding questions

Estimate the resources needed for care

Consider housing, daily care, education and other ongoing needs alongside available savings, benefits and existing coverage. Discuss a premium budget you could sustain.

The person providing care does not automatically control an insurance benefit. Your attorney can advise on a beneficiary, custodial or trust arrangement appropriate to the plan.

Anil’s insurance role

Match insurance to the timing of the need

Individual Term, Whole Life or IUL coverage may address a need at one insured person’s death, with different costs and policy requirements.

Survivorship life insurance generally pays after the second insured dies. Separately consider what a surviving parent or caregiver would need after the first death.

Coverage is not a guarantee that all future care costs will be met. Coordinate amounts and beneficiaries with your attorney. For New Jersey background on a minor’s property, see the Ocean County Surrogate’s explanation; it is not a nationwide rule.
